Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the LocalLoyalty mobile application and website (together, the "Service"), operated by SkyL4rk PTY LTD ("we", "us", "our"). By creating an account, joining a merchant's loyalty card, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What LocalLoyalty Is

LocalLoyalty is a free digital loyalty card platform. It allows users ("Users", "you") to collect digital stamps from participating local businesses ("Merchants") and redeem rewards once a card is complete. Merchants may list their loyalty programme on the Service free of charge.

2. Eligibility & Accounts

• You must provide accurate information when registering and keep your login details secure.
• You are responsible for all activity that occurs on your account.
• We may suspend or terminate accounts that we reasonably believe are used fraudulently, abusively, or in breach of these Terms.

3. Stamps, Cards & Rewards

• Stamps are issued by Merchants at their discretion, typically against a qualifying purchase, scanned via QR code or NFC.
• Rewards, stamp thresholds, and what qualifies for a stamp are set entirely by each Merchant — LocalLoyalty does not guarantee the value, availability, or terms of any specific reward.
• We reserve the right to detect and reverse stamps that were issued fraudulently, in error, or through abuse of the Service (including but not limited to repeated rapid scanning).
• Stamps and rewards have no cash value and cannot be exchanged, sold, or transferred between accounts unless explicitly stated by the Merchant.

4. Merchant Listings

• Merchants applying to list a loyalty card on LocalLoyalty must provide accurate business information and are subject to our approval before activation.
• We may suspend or remove a Merchant listing at our discretion, including for inactivity, complaints, or breach of these Terms.
• Merchants are solely responsible for fulfilling rewards promised to Users through their loyalty card.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in a way that infringes the rights of others;
• Attempt to manipulate, duplicate, or falsify stamps, QR codes, or NFC payloads;
• Reverse engineer, scrape, or interfere with the operation or security of the Service;
• Create multiple accounts to claim rewards beyond what a Merchant intends per person.

6. Advertising

LocalLoyalty is funded in part through advertising shown within the app. By using the Service, you agree to the display of such advertising. We do not control the content of third-party advertisements beyond our standard advertising policies.

7. Intellectual Property

The Service, including its design, branding, and underlying software, is owned by SkyL4rk PTY LTD and protected by applicable intellectual property laws. Merchant logos and branding remain the property of the respective Merchant.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, and we are not responsible for the conduct of Merchants, the quality of goods or services they provide, or their fulfilment of rewards.

9. Limitation of Liability

To the maximum extent permitted by law, SkyL4rk PTY LTD shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of stamps, rewards, or data.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated within the app where reasonably practicable.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.
